Marinus Analytics, LLC (“Marinus Analytics”, the “Company,” “we,” “us” or “our”) respects your privacy and is committed to protecting it. This Privacy Policy (this “Policy”) describes the types of information we may collect from or about you, when you visit the website www.marinusanalytics.com (the “Website”); use our services, including our Traffic Jam tool, ("Traffic Jam" or the "Tool”); or otherwise when communicating with the Company; as well as our practices for collecting, using, maintaining, protecting and disclosing that information.

Our mission is to serve those working on the frontlines of public safety by developing technology for them to disrupt human trafficking, child abuse, and cyber fraud. Our flagship tool, Traffic Jam, draws only on publicly available data from hotspots of potential exploitation on the internet and provides support to frontline professionals to stop and prevent human trafficking, recover victims, and dismantle organized criminal networks. We do not access any private communications or surveillance data.

 

To achieve our mission, we may collect, use, and disclose personal information (such as facial images) of individuals who are the subject of online advertisements or postings on publicly available websites or services considered hotspots of potential exploitation (“Ad Subjects”) in accordance with this Policy. We do not indiscriminately scrape publicly available websites on a speculative basis. We use biometric information and facial recognition technology in partnership with law enforcement agencies and a small number of non-government organizations for the limited purposes of detecting and/or hindering human trafficking activity. For example, our Tool facilitates the cross-referencing of digital images of Ad Subjects (collected from publicly available exploitation hotspots) against information provided to us by law enforcement professionals or carefully vetted counter-human trafficking partner organizations for the limited purpose of identifying persons that may have become victims of human trafficking. Access to our Tool is limited to those with specialized functions related to the investigation or prevention of major trafficking.

 

BY USING OUR WEBSITE, YOU CONSENT TO THE COLLECTION, STORAGE, USE, DISCLOSURE AND RETENTION OF YOUR PERSONAL INFORMATION BY US IN ACCORDANCE WITH THIS PRIVACY POLICY.  IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT ACCESS OR USE OUR WEBSITE OR TOOL.

By accessing or using the Website or the Tool, you agree to the terms of this Privacy Policy. This Policy may change from time to time (see Section 20 below, Changes to our Privacy Policy). Your continued use of the Website or the Tool after we make changes constitutes acceptance of those changes, so please check the Policy periodically for updates. We will notify you by email or by posting a notice on the Website’s and the Tool’s home page whenever there is a material change to this Privacy Policy.

When you provide Marinus Analytics with your personal information through the Website, Tool, or any of our forms, you consent to the collection, use, and disclosure of such information in accordance with this Policy or for the purposes identified to you at the time you provided the personal information.

3.               TRAFFIC JAM INFORMATION COLLECTION

The company’s flagship tool, Traffic Jam, uses advanced computing to help law enforcement and others identify and rescue victims of human trafficking, hinder or halt such activity, and support them in the prosecution of those engaging in human trafficking. Traffic Jam obtains information from publicly available websites or services providing relevant advertisements or postings. Traffic Jam’s data collection practices are in addition to those relating to visitors to our Website or users of Traffic Jam, and are outlined below.

We collect personal information without the knowledge or consent of Ad Subjects where the collection is clearly in their interests and their consent cannot be obtained in a timely way; or if it would be reasonable to expect that the collection with their knowledge or consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes relating to investigating illegal activities such as human trafficking. For example, we may collect personal information of an Ad Subject from publicly available and potentially exploitative websites or services without the Ad Subject’s consent for the purposes of detecting, hindering, and/or halting human trafficking activity.

4.               WHERE DOES THIS POLICY APPLY?

This Policy applies to information we collect:

  • ON THE WEBSITE;

    • from your use of Traffic Jam;

    • in email, text, and other communications between you and us; and

    • from information posted on publicly available websites as part of our efforts to identify and rescue victims of human trafficking, hinder or halt such activity, and support prosecution of those engaging in human trafficking (see Traffic Jam Information Collection below).

It does not apply to information collected by:

  •  except as described above, collection by any third party (including our affiliates and subsidiaries), through any application or content (including advertising) that may link to, be accessible from, or on, the Website.

Please be aware that we are not responsible for the privacy practices or content of other websites. Linked websites are maintained by third parties and are provided for your convenience and reference only. We do not operate or control, in any respect, any information, software, products or services available on such third party websites. The inclusion of a link to a website does not imply any endorsement of the service or the site, its contents, or its sponsoring organization. We encourage you to be aware that when you leave our Website, you should carefully read the privacy statements of each and every site that collects personally identifiable information.

5.  WHAT KINDS OF INFORMATION DO WE COLLECT?

The information we collect from you depends on how you use our Website and Tool.  We will only collect personal information that is reasonably necessary for the purpose of providing our Services to you. You should exercise discretion when disclosing your personal information to us, and should not disclose sensitive or confidential information that you wish to remain private.

Personal information means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

 

We may collect, use, store and transfer different kinds of personal information about you which we have grouped together as follows:

 

  • IDENTITY DATA INCLUDES FIRST NAME, MAIDEN NAME, LAST NAME, USERNAME OR SIMILAR IDENTIFIER, MARITAL STATUS, TITLE, DATE OF BIRTH AND GENDER.

  • CONTACT DATA INCLUDES BILLING ADDRESS, DELIVERY ADDRESS, EMAIL ADDRESS AND TELEPHONE NUMBERS.

  • FINANCIAL DATA INCLUDES BANK ACCOUNT AND PAYMENT CARD DETAILS.

  • TECHNICAL DATA INCLUDES INTERNET PROTOCOL (IP) ADDRESS, YOUR LOGIN DATA, BROWSER TYPE AND VERSION, TIME ZONE SETTING AND LOCATION, TIME AND DATE OF LOGIN, BROWSER PLUG-IN TYPES AND VERSIONS, OPERATING SYSTEM AND PLATFORM, AND OTHER TECHNOLOGY ON THE DEVICES YOU USE TO ACCESS THIS WEBSITE.

  • PROFILE DATA INCLUDES YOUR USERNAME AND PASSWORD, PURCHASES OR ORDERS MADE BY YOU, SETTINGS, FEEDBACK AND SURVEY RESPONSES.

  • USAGE DATA INCLUDES INFORMATION ABOUT HOW YOU USE OUR WEBSITE, PRODUCTS AND SERVICES, INCLUDING:

    • WHEN IT BECOMES AVAILABLE, THE “FOLDERS” FUNCTION, WHICH WILL STORE THE NAME OF ANY FOLDERS YOU CREATE AND ANY CONTENT YOU PLACE IN THOSE FOLDERS;

    • SEARCH CRITERIA, BUT ONLY IF YOU TURN ON “SAVE HISTORY” UNDER THE SETTINGS (THE DEFAULT SETTING IS THAT “SAVE SEARCH HISTORY” IS TURNED OFF, WHICH MAY BE CHANGED IN “SETTINGS”); BUT PLEASE NOTE: WE DO NOT MONITOR USER SAVE HISTORY; AND

    • CUSTOMER SUPPORT INTERACTIONS THROUGH CHATLIO AND OTHER MEANS.

  • MARKETING AND COMMUNICATIONS DATA INCLUDES YOUR PREFERENCES IN RECEIVING MARKETING FROM US AND OUR THIRD PARTIES AND YOUR COMMUNICATION PREFERENCES.

 

We also collect, use, store and transfer different kinds of personal information that is Ad Subject Data, which may include aliases, social media handles, race, ethnicity, gender identity, sexual orientation, sexual preferences and other data about the sex life of Ad Subjects. Further information about the types of data we collect and how we collect it is provided in Section 6 below. No Ad Subject Data is collected about Traffic Jam users.

 

Traffic Jam does not retain or store any case information or other personal information obtained from law enforcement agencies for the purposes of detecting or hindering human trafficking activity. Our Tool only uses information scraped from publicly available adult service website sources on the internet for this purpose.

 

6.   HOW WE COLLECT PERSONAL INFORMATION ABOUT YOU

We collect information on or through our Website or Tool in the following ways:

·       directly from you when you provide it to us, including by filling in forms or answering surveys, on the Website or Tool or at the time of subscribing to receive information from us and when you contact us directly. We may also ask you for information when you report a problem with the Website or Tool;

·       from third parties in connection with providing our services to you. Additionally, we may receive content, communications and information that other users provide when they use the Website. This can include information about you, such as when others send a message to you through the Website; and

·       from automated data collection technologies including cookies, tags, web beacons, pixels and other technologies as defined further in Section 7 below.

 

Information Collection on Ad Subjects (not Website or Tool users)

We receive personal information about Ad Subjects, not Traffic Jam users, from various third parties and public sources, including Adult Services Websites (“ASWs”) as set out below:

·       CONTACT, FINANCIAL AND TRANSACTION DATA FROM PROVIDERS OF TECHNICAL, PAYMENT AND DELIVERY SERVICES.

·       IDENTITY AND CONTACT DATA FROM DATA BROKERS OR AGGREGATORS, INCLUDING ASWS.

·       IDENTITY AND CONTACT DATA FROM PUBLICLY AVAILABLE SOURCES, INCLUDING ASWS.

7.               AUTOMATIC DATA COLLECTION TECHNOLOGIES

As you navigate through and interact with our Website or Tool, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website or Tool, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website or Tool; and

  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

     

The information we collect automatically is only statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Website or Tool and to deliver a better or more personalized service, including by enabling us to:

  • ESTIMATE OUR AUDIENCE SIZE AND USAGE PATTERNS;

  • SPEED UP OUR WEBSITE OR TOOL;

  • DELIVER BETTER, MORE ORGANIZED CONTENT; AND

COOKIES SET BY THIRD PARTY SITES

To enhance our content and to deliver a better online experience for our users, we sometimes embed images and videos from other websites on the Website. We currently use, and may in the future use, content from websites such as Facebook, LinkedIn and Twitter. You may be presented with cookies from these third party websites. Please note that we do not control these cookies. The privacy practices of these third parties will be governed by the third parties’ own privacy statements or policies. We also use Google, a third party analytics provider, to collect information about Website and/or Tool usage and the visitors to the Website and/or Tool, including demographic and interest-level information. Google uses cookies in order to collect demographic and interest-level information and usage information from users that visit the Website and/or Tool, including information about the pages where users enter and exit the Website and/or Tool and what pages users view on the Website and/or Tool, time spent, browser, operating system, and IP address. 9.          DO NOT TRACK OPTION

Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) incorporate a “Do Not Track” (“DNT”) or similar feature that signals to websites that a user does not want to have their online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about the browser’s user. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, many website operators, including Marinus Analytics, do not respond to DNT signals.

We use information that we collect about you or that you provide to us, including any personal information:

We may use the personal information of Ad Subjects without their knowledge or consent if, as part of our efforts to identify and rescue victims of human trafficking and hinder or halt such activities, we become aware of information that indicates that human trafficking has been, is being, or is about to be committed, and we have reasonable grounds to believe such information could be useful in the investigation of human trafficking; in these circumstances, an Ad Subjects personal information will be used for the limited purpose of investigating such activities.

We may use aggregated information about our users, and information that does not identify any individual, without restriction (“Anonymized Aggregated Information”).

11.               HOW WE USE SEARCH DATA

We may retain personal information of third parties provided to us by Traffic Jam users when they upload this information to our Website or Tool on a for the purpose of using the search function. The search function will compare the information uploaded, such as facial images (“Search Data”), with the Tool’s database of Ad Subjects to determine if a match can be found. Search Data uploaded to Traffic Jam remains accessible only to the Traffic Jam user who uploaded the image (the “Uploader”) and remains inaccessible to all other Traffic Jam users. Search Data will remain accessible to the Uploader until deleted by the Uploader. The Uploader can view their Search Data on the image search page, while logged into the Tool. Our team does not access Search Data, in accordance with our privacy practices. Search Data in transit is protected through HTTPS, security certificates, and usernames and passwords between users and the web application. Access to all systems is maintained and restricted to individual user accounts. Search Data is protected between services via SSL, username and passwords, and whitelisted IP addresses.

 

12.               DISCLOSURE OF YOUR INFORMATION

We may disclose your personal information to External Third Parties (as defined below):

  • TO PROVIDE, MAINTAIN, EVALUATE AND IMPROVE OUR WEBSITE, THE TOOL AND ANY OTHER PRODUCTS AND SERVICES OF OURS TO COMBAT HUMAN TRAFFICKING OR OTHERWISE;

  • TO FULFILL THE PURPOSE FOR WHICH YOU PROVIDE IT (FOR EXAMPLE, IF YOU GIVE US AN E-MAIL ADDRESS TO USE SO YOU CAN RECEIVE UPDATE ALERTS FROM ADS YOU HAVE FLAGGED IN THE TOOL, WE WILL UTILIZE THAT EMAIL ADDRESS TO DELIVER THE ALERTS TO YOU);

  • WHEN CONTRACTING WITH EXTERNAL THIRD PARTIES (AS DEFINED BELOW) WHO HELP US PROVIDE, MAINTAIN AND IMPROVE THE WEBSITE OR TOOL. WE MAY CONTRACT WITH EXTERNAL THIRD PARTIES TO HELP US MANAGE, MONITOR AND OPTIMIZE OUR WEBSITE OR TOOL OR TO MARKET OUR GOODS AND SERVICES. TO THE EXTENT THAT ANY PERSONAL INFORMATION IS PROVIDED TO THESE EXTERNAL THIRD PARTIES, WE REQUIRE THAT THEY BE BOUND BY OBLIGATIONS CONSISTENT WITH THIS POLICY AND THAT THEY ONLY COLLECT, USE, OR DISCLOSE YOUR PERSONAL INFORMATION FOR THE PURPOSE OF PROVIDING SUCH SERVICES TO US.   • TO A BUYER OR OTHER SUCCESSOR IN THE EVENT OF AN ACQUISITION, MERGER, DIVESTITURE, RESTRUCTURING, REORGANIZATION, DISSOLUTION OR OTHER SALE OR TRANSFER OF SOME OR ALL OF THE COMPANY'S ASSETS OR EQUITY, IN WHICH YOUR PERSONAL INFORMATION IS AMONG THE ASSETS TRANSFERRED;

  • FOR ANY OTHER PURPOSE DISCLOSED BY US WHEN YOU PROVIDE THE INFORMATION; AND

  • WITH YOUR CONSENT.

We may also disclose your personal information:

  • To comply with any court order, law or legal process, including to respond to any government or regulatory request;

  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes;

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction;

  • To a government institution or part of a government institution that has made a request for the information, identified its lawful authority to obtain the information, and indicated that the disclosure is requested for the purpose of enforcing any law of Canada, a province or a foreign jurisdiction, carrying out an investigation relating to the enforcement of any such law, or gathering intelligence for the purpose of enforcing any such law; and

  • To a law enforcement agency for the purposes of investigating human trafficking or other illegal activity that is being or about to be committed, and it would be reasonable to expect that disclosure with the knowledge or consent of the individual would compromise the investigation.

External Third Parties we share information with include:

  • SERVICE PROVIDERS ACTING AS PROCESSORS WHO PROVIDE IT AND SYSTEM ADMINISTRATION SERVICES.

  • PROFESSIONAL ADVISERS ACTING AS PROCESSORS OR JOINT CONTROLLERS INCLUDING LAWYERS, BANKERS, AUDITORS AND INSURERS WHO PROVIDE CONSULTANCY, BANKING, LEGAL, INSURANCE AND ACCOUNTING SERVICES.

  • REGULATORS AND OTHER AUTHORITIES WHO REQUIRE REPORTING OF PROCESSING ACTIVITIES IN CERTAIN CIRCUMSTANCES.

We do not share personal information of our customers, users, website visitors, or those on our mailing lists. We only share personal information of Ad Subjects to further our efforts to combat human trafficking.

We may disclose Anonymized Aggregated Information about our users, and information that does not identify any individual, without restriction.

18.            DATA RETENTION AND STORAGE OF PERSONAL INFORMATION

We retain personal information for only as long as necessary to provide the services and fulfill the transactions you have requested, or for other business purposes, including but not limited to complying with our legal obligations, resolving disputes, and enforcing our agreements. We are required by law to keep some types of information for certain periods of time (e.g., statute of limitations).

 

We may retain Search Data uploaded by Traffic Jam users for the purpose of using the search function. Search Data uploaded to Traffic Jam remains accessible only to the Traffic Jam user who uploaded the image (the “Uploader”) and remains inaccessible to all other Traffic Jam users. Search Data will remain accessible to the Uploader until deleted by the Uploader. Our team does not access Search Data, in accordance with our privacy practices. Search Data in transit is protected through HTTPS, security certificates, and usernames and passwords between users and the web application. Access to all systems is maintained and restricted to individual user accounts. Search Data is protected between services via SSL, username and passwords, and whitelisted IP addresses.

We do not retain or store any case information or other personal information obtained from law enforcement agencies for the purposes of detecting or hindering human trafficking activity. Our software only uses information scraped from publicly available adult service website sources on the internet for this purpose. Personal information that is no longer required will be securely destroyed, erased or made anonymous according to our guidelines and procedures. We currently store and process your personal information and other content you provide to us on servers located in the United States. Our servers follow industry standards pertaining to security. In some circumstances, your personal information may be stored, processed, shared or otherwise used on servers belonging to External Third Parties based in other countries. Our service providers are only permitted to store, process and access your personal information, and are not otherwise authorized to collect, use or disclose your personal information, except in accordance with the purposes set out in this Privacy Policy or as required by applicable law.
